Custody vs. Placement: Understanding Wisconsin Law
Wisconsin law draws a clear distinction between legal custody and physical placement, and understanding this difference is essential.
Legal Custody (Decision-Making)
Legal custody refers to the right and responsibility to make major decisions for the child, including:
- Non-emergency medical care
- Education (school selection, tutoring, etc.)
- Religious upbringing
Courts generally favor Joint Legal Custody, where both parents share decision-making authority. Sole Legal Custody is reserved for circumstances involving documented safety concerns, parental incapacity, or situations where the parents cannot communicate effectively enough to jointly make custodial decisions.
Physical Placement (Where the Child Lives)
Physical placement determines where the child resides and how much time they spend with each parent.
- Primary Placement: One parent has the child for the majority of overnights.
- Shared Placement: Each parent has the child for at least 25% of the time (92 or more overnights per year). Shared placement is common and does not necessarily require a 50/50 schedule.

- How transitions between homes may affect the child
- The mental and physical health of each parent
- Any history of domestic abuse, child abuse, or relevant criminal convictions
- Each parent’s willingness to support the other parent’s relationship with the child
- Any additional factors the court considers relevant
